In fact, while trafficking certainly does encompass the transportation of drugs, it is also used to describe a wide array of other actions involving controlled or counterfeit substances.

           Referring patients to a specialist—podiatrist, neurologist, or ENT, for example—is a common outcome for many patients seen by general practitioners and internists. Webs of connected medical professionals are more complex than ever. While many can interpret that as one of many signs of an advancing health care system, government programs are keen to make sure medical referrals, services, and products are made in good faith. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           In 1986, Congress passed the federal Anti-Kickback Statute (AKS). This law prohibits “remuneration” for patient referrals or arrangements for furnishing of products or services that are paid by a federal health care program. AKS violations typically involve Medicare, though they are occasionally associated with Medicaid or TRICARE. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            ﻿
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Common Anti-Kickback Statute Violations
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           An example of one of the most blatant AKS violations would be a doctor who receives money for referring his patients to a particular gastroenterologist. This distilled version of an AKS violation usually manifests itself through more complex schemes and illegal arrangements. Such a scheme might involve:
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;ul&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            A specialist who rents out a space in her medical facility to a physician at a discounted rate (below fair market value). In turn, the physician refers patients to the specialist; 
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            A doctor who is paid “consultant” or “advisor” fees by specialists who receive referrals from the doctor; a sign of illegal kickbacks in this situation would be the absence of actual services rendered by the doctor purported to be a consultant; 
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Unfair investment opportunities in medical facilities for doctors who pledge to refer patients to the completed facilities; 
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Payments to doctors who send specimens to certain laboratories or testing facilities; or 
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Pharmaceutical companies who simply pay doctors to prescribe their medications. 
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/li&gt;&#xD;
  &lt;/ul&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Why the Government Cares About Illegal Kickbacks? 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           The Department of Justice and Health and Human Services aggressively prosecute AKS violations for more reasons than wasted tax money. At a basic level, the federal government asserts that patients deserve to be treated by health care professionals who have the best interests of the patient in mind. Receiving or providing kickbacks provides obvious incentives that may result in unnecessary tests or procedures for patients. Unfair competition among medical providers is also a concern of federal agents. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;

           Penalties for Anti-Kickback Statute Violations
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           A conviction for a federal AKS violation carries a maximum prison sentence of five years and a fine of up to $25,000. Those convicted are usually subject to a period of disbarment from participating in public health care programs. Additionally, civil penalties may be levied against violators. The amount per penalty can reach up to $50,000 plus three times the monetary value of the remuneration involved in the violation.

    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;

                    Often times people will get together and go out for a night on the town, to a sporting event, or to a party and find themselves in a situation where they are arrested for “public intoxication.”  What is the offense of public intoxication?
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    So, let’s define some terms:  What is a “
    
  
  
                    &#xD;
    &lt;b&gt;&#xD;
      
                      
    
    
      public place
    
  
  
                    &#xD;
    &lt;/b&gt;&#xD;
    
                    
  
  
    “?  By statute, a public place is defined as any place where the public or a substantial group of the public has access, and includes, but is not limited to, streets, highways, and the common areas of schools, hospitals, apartment houses, office buildings, transport facilities, and shops. TX Penal Code 1.07(a)(40).   This would include sporting venues, festivals and the fair grounds.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    What does “
    
  
  
                    &#xD;
    &lt;b&gt;&#xD;
      
                      
    
    
      intoxication
    
  
  
                    &#xD;
    &lt;/b&gt;&#xD;
    
                    
  
  
    ” mean?  Again, under the penal code, intoxication means, “not having the normal use of mental or physical faculties by reason of the introduction of alcohol, a controlled substance, a drug, a dangerous drug, a combination of two or more of those substances, or any other substance into the body; or having an alcohol concentration of .08 or more.” TX Penal Code 49.01(2)(A)&amp;amp;(B).
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    It is not enough for a person to be in a public place and be intoxicated.  
    
  
  
                    &#xD;
    &lt;b&gt;&#xD;
      
                      
    
    
      Public intoxication
    
  
  
                    &#xD;
    &lt;/b&gt;&#xD;
    
                    
  
  
     requires also that the person be intoxicated 
    
  
  
                    &#xD;
    &lt;em&gt;&#xD;
      
                      
    
    
      to the extent that
    
  
  
                    &#xD;
    &lt;/em&gt;&#xD;
    
                    
  
  
     they are a danger to themselves or another person. “Physical manifestations of alcoholic consumption alone are not sufficient to constitute public intoxication. Rather, the State must demonstrate proof of potential danger either to the appellant himself or to others.”
    
  
  
                    &#xD;
    &lt;em&gt;&#xD;
      
                      
    
    
       Simpson v. State
    
  
  
                    &#xD;
    &lt;/em&gt;&#xD;
    
                    
  
  
    , 886 S.W.2d 449, 455 (Tex. App.-Houston 1994).  A finding of potential danger generally requires the existence of some risky or precarious circumstances.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    What is somewhat subjective is determining if a person is “a danger to himself or to another.” Officers look to the “potential dangers” that may exist when determining whether to arrest someone for public intoxication.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    Below are some common situations where people can end up getting arrested for public intoxication because it draws the attention of the police:
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    These are good reminders to help avoid getting arrested for public intoxication when you are out and about. However, if this information comes a little too late, it is always advisable to seek the advice of a criminal  defense attorney to help you navigate the criminal justice system in order to protect your rights and seek a resolution that is in your best interest.

                    Is it wise for a person to represent himself or herself when they are accused of committing a crime? The wise person says, “No.” The fool says, “Yes.” The age old wisdom of Lincoln is as true today as it was back then. Why? The simple answer is because a criminal defense attorney’s job is to protect a person and their rights from being trampled on by the Government when he or she is being accused of a crime. A person going it alone against the power and resources of the government simply doesn’t stand a fighting chance.

The case is a battle, a war fought in the trenches of the courtroom with an adversary who has great power and seemingly limitless resources.

                    Driving while intoxicated, i.e. DWI, is one of the most prosecuted cases in America.  If you go out, drink, get in your vehicle and drive, you could find yourself being accused of DWI if you are pulled over by law enforcement for even the smallest traffic violation.
